3. Submissions & Rules of Conduct

You are fully responsible for any and all Content and comments you post on artistrack.com. ArtistRack does not endorse, edit, verify, or vouch for user comments or content accuracy. You may be held legally liable if the Content you post infringes any patent, trademark, copyright, or proprietary right. By using artistrack.com, you agree NOT to:

Editing & Modification: We reserve the right in our sole discretion to edit, modify, or delete any material, content, or comment that appears on ArtistRack at any time for any reason without prior notice.

Law Enforcement Disclosure: You acknowledge and agree that ArtistRack may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith belief to comply with legal processes or protect the rights and safety of ArtistRack and the public.

4. Payments, Refunds, & Chargeback Policy

You represent and warrant that if you are purchasing something from us that (i) any credit/debit card information you supply is true and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices.

• Refund Policy: All transactions are final and non-refundable once processed. In the event we are unable to deliver a service through no fault of your own, ArtistRack will refund or credit the amount received. This sets forth your sole and exclusive right to refund.
• Fraudulent Chargebacks: Initiating a fraudulent chargeback constitutes theft. We reserve the right to dispute these claims fully with your bank using server logs and submission data. Accounts initiating fraudulent disputes will be permanently banned and associated press features will be removed.

5. Disclaimers & Limitations of Liability

Information from artistrack.com is provided on an 'as is' and 'as available' basis. All warranties, expressed or implied, are disclaimed. To the fullest extent permitted by law, ArtistRack is strictly not liable for the following:

• No Guarantee of Results: ArtistRack provides marketing, exposure, and PR services. We do not and cannot guarantee specific numerical results, stream counts, follower growth, chart placements, financial earnings, or viral success. Audience reception is entirely subjective.
• Third-Party Platform Actions: Platforms such as Spotify, Apple Music, YouTube, and social media networks govern their own platforms. ArtistRack is not liable under any circumstances if a third-party platform flags, removes, shadow-bans, or deletes your music, profile, or account. We are not responsible for algorithm changes made by these external entities.
• Service Interruptions: We are not liable for any delay, bug, or interruption in the transmission of our website or services, nor any indirect, special, incidental, or consequential damages (including loss of profits) arising from your use of this website.

Our maximum liability to you under all circumstances will be equal to the exact purchase price you paid for any goods or services.

ArtistRack may contain links to other web sites or advertise third-party sites from which you can purchase goods or services. We do not operate or control these products or services. You agree that use of such Third-Party Sites is entirely at your own risk.

Indemnification: You agree to fully indemnify, defend, and hold ArtistRack, our partners, staff, and affiliates harmless from any liability, loss, claim, and expense (including legal fees) related to your violation of this Agreement, your use of the Site, or by you uploading any content that infringes upon third-party rights.

7. Data Collection & Privacy

We reserve the right to use all information provided by you in a format consistent with our Privacy Policy. We may collect data supplied by you to enroll you into our newsletter. We may share your details with carefully selected third parties that you may be interested in. All marketing emails will contain a link to opt out.

8. Force Majeure & Jurisdiction

Force Majeure: ArtistRack shall not be held liable for any failure or delay in performing its obligations under this Agreement if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, server outages, internet infrastructure failures, or government actions.

Severability: If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

Jurisdiction: These terms of use are governed by UK English law. Any dispute arising in connection with these terms of use shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
